A head teacher had been fairly dismissed for gross misconduct for failing to disclose her relationship with a person convicted of making indecent images of children
Facts: although the head teacher and Y were not cohabiting they had a close personal relationship and the head teacher failed to disclose to the school authorities that Y had been convicted of making indecent images of children and had been sentenced to a community order and a sexual offences prevention order forbidding him from having unsupervised access to children under 18.
Judgment: the Court of Appeal (Elias, Black and Floyd LJJ) dismissed the head teacher’s appeal from the employment tribunal’s decision upholding the school’s dismissal of the head teacher as being fair: her relationship with Y had posed a risk to children at the school and she ought to have disclosed it.
